Release and Waiver — Ethos Parkour and Movement Inc

This is an important agreement which affects your legal rights. Please take the time to read this agreement carefully, and ensure that you understand its terms.

Ethos Parkour and Movement Inc. hosts a variety of activities involving parkour, including vigorous physical activity, climbing over obstacles, and leaping across hazards. By signing this agreement and participating in an activity hosted by Ethos Parkour and Movement Inc. (the “Activity”), you agree as follows:

Participant’s Confirmation
I am aware that the Activity involves moving rapidly through an area, typically in an urban environment, negotiating obstacles by running, jumping, and climbing. I understand the Activity also includes a vigorous blend of parkour with traditional games, such as dodgeball and ball-tag, and may include “Nerf gun” events, with soft projectiles being propelled through the air while participants are running rapidly. I am aware that, for any Activity that takes place outside of Ethos Parkour and Movement Inc.’s facility, other members of the public may also be using those spaces. I understand that there are certain risks inherent in parkour, such as slips and falls while running or climbing, falling from heights, and the actions of other participants in the Activity. I acknowledge that the risk of injury cannot be eliminated without destroying the unique character of the Activity, and I knowingly choose to participate.

I accept and assume the entire responsibility and liability for my own safety, and for all of my actions and omissions, while participating in the Activity.

I am not now under a disability which might impair or prevent my safe or lawful participation in the Activity. If I am under the influence of alcohol or drugs, or have any other impairment, I will not participate in any Activity.

If I learn of any unusual hazard or unsafe condition, I will immediately notify Ethos Parkour and Movement Inc., its employees, or its agents.

2. Release and Waiver

I agree that all of my participation will be at my own risk, and I unconditionally and voluntarily assume the entire risk of any and all accidents, incidents or personal injury, including death, which I may suffer, however caused.

I unconditionally and irrevocably release and discharge Ethos Parkour and Movement Inc. from all actions, claims or demands, which I may have at any time as a consequence of my participation in the Activity, for any loss, damage or injury to myself or to any property. I willingly give this release even if the loss, damage or injury may have been contributed to by any act or failure to act of Ethos Parkour and Movement Inc.. This release includes, without limitation, any claims for negligence by Ethos Parkour and Movement Inc. or any failure to take careful measures that are available and understood to be necessary for safety.

I waive my right to bring any legal action against Ethos Parkour and Movement Inc. arising out of my participation in the Activity.

I consent to the use of my likeness in videos and photos promoting Ethos Parkour and Movement Inc.

3. Miscellaneous

This Release shall enure to the benefit of and be binding upon the parties hereto and their respective heirs, executors, and administrators, successors and permitted assigns.

This Release shall be governed by and interpreted in accordance with the laws of the Province of British Columbia. Each of the parties irrevocably attorns to the jurisdiction of the courts of the Province of British Columbia with respect to all matters arising out of this Release.

If any provision of this Release is incapable of being enforced by reason of any rule of law or public policy, all other conditions and provisions of this Release shall nevertheless remain in full force and effect. No covenant or provision shall be deemed dependant upon any other covenant or provision unless so expressed in this Release.

Any obligations of this Release that have not been fulfilled at the completion the Activity shall survive until fulfilled.

I have read and I understand the terms of this Release. I agree that the terms of this Release are reasonable, and I voluntarily accept them as a condition of my participation in the Activity.
